An IT solutions provider has asked the High Court to allow it to recover nearly K3 billion from funds belonging to Blantyre Water Board held by six banks and mobile-money operators, following judgments against the public utility.

Madalitso Chika, trading as Mortech IT Solutions, has filed a without-notice application for a Third-Party Debt Order against National Bank of Malawi, FDH Bank, First Capital Bank, Ecobank Malawi, Airtel Mobile Commerce and TNM Mpamba.

The application is part of enforcement proceedings arising from Commercial Cause Number 146 of 2024, in which Mortech is pursuing payment from Blantyre Water Board.

According to the application, the amount outstanding is K2,963,466,047.93, comprising K2,576,926,998.20 in principal and interest and K386,539,049.73 in collection costs.

The enforcement action follows judgments delivered on 20 May 2026 and 2 July 2026, which established BWB’s liability to Mortech.

Mortech is now asking the High Court to direct the six named institutions to pay to it any money they hold for Blantyre Water Board, up to the amount required to settle the judgment debt.

Court records show that the underlying case has been before the High Court Commercial Division for about two years. The court also dealt with applications concerning collection costs in March 2026, including the question of whether new procedural rules could apply retrospectively.

The latest application is a without-notice application, meaning Mortech has asked the court to consider the enforcement request without prior notice to Blantyre Water Board.

A Third-Party Debt Order, commonly referred to as a garnishee order, is a post-judgment enforcement mechanism through which a creditor can seek payment from money owed to, or held for, the judgment debtor by a third party.

The application was filed by Soko & Co., through lawyer Khumbo Bonzoe Soko, and is before Justice Trouble Kalua.

If the court grants the application, the named banks and mobile-money operators could be required to pay qualifying funds held for Blantyre Water Board directly towards the outstanding judgment debt.
